Definitions
Account Types & Registration
Guest Access
Users may access basic upload and sharing functionality without registration. A guest session is automatically created upon first connection. Guest sessions are ephemeral and intended for quick, temporary sharing. No personal data is required.
Free Account
To create a free account, Users must provide a valid email address. A secure login link is sent to that address — no password is required. The email address serves as the account identifier. Free accounts provide access to the File Manager, basic API operations, and the ability to manage content across sessions. Free accounts are subject to ephemeral storage retention policies and display advertisements.
Premium Account
Users may upgrade to a Premium account via Subscription or Pay-as-You-Go plans. Premium unlocks permanent storage, increased traffic allowances, direct link generation, advanced file manager features, full API access, CDN capabilities, priority server access, and an ad-free experience. Premium features and allowances are detailed on the Premium page and may evolve over time.
Accuracy of Information: The User guarantees that all information provided during registration and account usage is true, accurate, current, and complete. Gofile reserves the right to suspend or terminate any account found to be using false, inaccurate, or incomplete information.
Service Description
Gofile provides a cloud storage platform that allows Users to upload, store, organize, and share digital content. The Service operates across multiple geographic regions with storage datacenters in Paris (France) and Phoenix (United States), and a global network of upload and download proxy servers to optimize performance worldwide.
Users may share content publicly via download pages or keep content private within their account. Premium Users may additionally generate direct links for embedding, integration, and content delivery, with configurable access controls including password protection, IP restrictions, domain allow/block lists, and expiration dates.
Gofile also provides a REST API, documented at /api, enabling programmatic access to upload, manage, and serve content. The API is currently in BETA and is subject to change. Most API endpoints require a Premium account.
Gofile acts as a hosting provider within the meaning of applicable legislation. Content stored on Gofile is under the sole responsibility of the User who uploaded it. Gofile does not claim ownership over User Content and does not monitor, screen, or review Content unless required by law or in response to a valid abuse report.
Free Services
Gofile offers a free tier intended for quick, temporary file sharing. Free accounts are subject to the following conditions, which the User expressly acknowledges and accepts:
- Ephemeral Storage: Content on free accounts is retained for a limited period. While content that remains actively downloaded may be kept longer, Gofile does not guarantee any specific retention duration for free accounts and may delete inactive content at any time without notice.
- Traffic Allowance: Free accounts are subject to a monthly traffic cap. Traffic may be counted by IP address; Users on shared IPs (schools, offices, VPNs) may have their usage aggregated with other Users on the same IP.
- Advertising: Free accounts display advertisements. The User agrees that Gofile may serve ads through its platform as part of the free offering.
- Feature Limitations: Certain features — including direct links, cold storage import, advanced file manager operations, and most API endpoints — are reserved for Premium accounts.
Premium Services & Payment
Subscription Plans
Subscription plans provide a fixed monthly allowance of storage and traffic for a recurring fee. Subscriptions renew automatically at the end of each billing period unless cancelled. Current pricing and allowances are published on the Premium page and may be updated from time to time.
Important: Recurring subscription payments are processed by a third-party merchant of record, not by Gofile. Please refer to the Merchant of Record subsection below for details.
Pay-as-You-Go & One-Shot Payments
Pay-as-You-Go is a credit-based model where Users are charged based on actual storage consumed and data transferred. A minimum monthly usage fee applies. Users may purchase credits in advance. Unused credits do not roll over indefinitely. Pay-as-You-Go credits and yearly Premium one-shot payments are processed directly by Gofile (WOJTEK SAS).
Merchant of Record (Subscriptions)
All recurring subscription payments are processed by our designated merchant of record. The merchant of record is responsible for payment processing, billing, invoicing, and handling payment-related inquiries for subscription plans. By subscribing, you enter into a payment relationship with the merchant of record for the recurring billing component, while the Service itself continues to be provided by Gofile (WOJTEK SAS).
Payment Terms
All payments are processed at the time of order. Upon successful payment, the User receives a confirmation email. The order is final once payment is confirmed. Premium features are activated immediately upon successful payment processing.
In the event of payment failure for a Subscription plan, the User's account is downgraded to a free account with the associated features and limitations. Gofile will make reasonable efforts to notify the User of any payment issues by email.
Refunds
Due to the digital nature of the Service, payments are generally non-refundable once the Service has been provided. However, each case is evaluated individually. Refunds may be granted in cases of demonstrable error, unresolved technical issues attributable to Gofile, or payments made in error. The User acknowledges that the statutory 14-day withdrawal period applicable to consumer contracts does not apply once the Service has commenced.
For subscription-related refund requests, please contact the merchant of record. For refunds related to Pay-as-You-Go credits or one-shot yearly payments, please contact Gofile through the contact page.
User Obligations & Prohibited Use
The User is solely responsible for all Content they upload to, store on, or share through Gofile. The User agrees not to use the Service — and not to permit or enable others to use the Service — for any of the following purposes:
Illegal Content
Uploading, storing, sharing, or distributing any content that violates applicable local, national, or international laws. This includes — but is not limited to — child sexual abuse material (CSAM), terrorist propaganda, content promoting violent extremism, and any material deemed unlawful in jurisdictions where Gofile operates or where the User resides.
Intellectual Property Infringement
Uploading, storing, sharing, or distributing any content that infringes upon the copyright, trademark, patent, trade secret, or other intellectual property rights of any third party. This includes pirated software, unlicensed media, counterfeit goods, and any content used without the express authorization of the rights holder.
Harmful & Malicious Content
Distributing malware, viruses, ransomware, spyware, phishing kits, or any other malicious software or code. Also prohibited are materials designed to compromise the security, privacy, or integrity of any individual, organization, computer system, or network.
Hate Speech, Harassment & Abuse
Content that incites hatred, violence, or discrimination against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any protected characteristic. Also prohibited: content used for harassment, stalking, doxing, blackmail, extortion, or targeted intimidation of any individual or group.
Platform Abuse
Attempting to circumvent storage limits, traffic allowances, or rate limits through automated means, multiple accounts, or other deceptive practices. Using the Service to send spam or unsolicited commercial communications. Interfering with or disrupting the integrity, security, or performance of the Service, its infrastructure, or any other user's enjoyment of the platform. Attempting to gain unauthorized access to accounts, systems, or data belonging to Gofile or other Users. Excessively consuming resources in a manner that degrades the experience for other Users.
Enforcement: Gofile reserves the right to remove any Content that violates these terms, suspend or terminate any account engaged in prohibited activity, and refer serious violations — particularly those involving CSAM, terrorism, or imminent threats — to the appropriate law enforcement authorities. For full details on our moderation practices, please see our Abuse Policy.
Intellectual Property
All elements of the Gofile platform itself — including but not limited to the website, user interface, logos, graphics, trademarks, software, API, documentation, and infrastructure — are the exclusive property of WOJTEK SAS and are protected by French and international intellectual property laws, including copyright and database protection legislation.
The User retains full ownership of all Content they upload to the Service. By using the Service, the User grants Gofile a limited, non-exclusive, worldwide, royalty-free license to store, process, and serve the User's Content solely as necessary to provide the Service (including making public Content accessible through download pages and direct links as configured by the User). This license terminates when the User deletes the Content or when the Content is removed in accordance with these Terms.
Gofile respects the intellectual property rights of others and expects its Users to do the same. Rights holders who believe their work has been infringed may submit a notice through our contact page. We respond promptly to properly submitted notices that comply with applicable laws, including the Digital Millennium Copyright Act (DMCA).
Data & Privacy
Gofile is committed to minimizing data collection. In its most basic use (guest access), Gofile collects no personal data whatsoever. When a free account is created, only the User's email address is stored. When a Premium subscription is purchased, billing-related information is collected as necessary to generate invoices and process payments. Under no circumstances will Gofile sell or rent personal data to third parties.
Content stored on Gofile is encrypted at rest on our servers. However, Gofile is not an end-to-end encrypted service — server-side encryption is used, which allows Gofile to provide features such as direct links, ZIP generation, and content scanning. Users requiring maximum confidentiality are encouraged to encrypt files locally before uploading.
For complete details on how we collect, use, and protect personal data, please refer to our Privacy Policy.
Service Availability & Liability
Gofile strives to maintain high availability and performance, but given the inherent complexities of internet infrastructure, the Service is provided on an "as is" and "as available" basis. Gofile is subject to a general obligation of means, not an obligation of result.
Gofile shall not be held liable for damages arising from:
- Service interruptions, downtime, or degradation, whether planned or unplanned
- Data loss, corruption, or unauthorized access resulting from circumstances beyond Gofile's reasonable control
- Actions taken in compliance with legal obligations, including content removal in response to valid abuse reports or law enforcement requests
- Third-party services, websites, or content linked to or from the Gofile platform
- The conduct or Content of any User
Gofile's total liability, whether in contract, tort, or otherwise, shall not exceed the amount paid by the User to Gofile in the twelve months preceding the event giving rise to the claim. For free accounts, Gofile's liability is limited to the fullest extent permitted by applicable law.
Account Termination
By the User: Users may stop using the Service at any time. Premium subscriptions may be cancelled through the profile page; cancellation takes effect at the end of the current billing period. Users may delete their Content and request account deletion at any time.
By Gofile: Gofile reserves the right to suspend or terminate any account, with or without notice, in the following circumstances:
- Violation of these Terms of Service or the Abuse Policy
- Engagement in illegal activity through the platform
- Extended account inactivity exceeding one year, for security and data integrity purposes
- Non-payment of Premium fees
- Force majeure events or circumstances that make continued service provision impossible or impractical
Upon termination, the User's right to access the Service ceases immediately. Gofile may delete all Content associated with the terminated account. Gofile shall not be liable to the User or any third party for termination of access to the Service.
Modifications to These Terms
Gofile reserves the right to modify these Terms of Service at any time. Material changes will be communicated to registered Users by email or through a notice on the platform. For non-material changes, the updated Terms will be published on this page with a revised effective date.
Continued use of the Service after modifications become effective constitutes acceptance of the revised Terms. If the User does not agree to the changes, they must discontinue use of the Service and may terminate their account. Gofile also reserves the right to modify, suspend, or discontinue any aspect of the Service, temporarily or permanently, with or without notice, including but not limited to feature sets, storage limits, traffic allowances, and pricing.
Governing Law & Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of France, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the competent courts of Paris, France.
For any exchange of information by email, the date and time recorded on Gofile's servers shall be authoritative between the parties. All formal notifications and communications provided for in these Terms shall be considered validly delivered if addressed by registered mail with return receipt to the company address stated in Section 1.
The User acknowledges that digital records, logs, messages, and data stored in Gofile's computer systems may be used as evidence in the context of any dispute relating to these Terms.
